Whilst the culture of making late payments remains well entrenched in the construction industry, there appears to be a modest downward trend in the frequency of late payments since the study.

It is now reasonably certain that the act of endorsing payment claims encourages communication between the parties, thus providing an opportunity for early dispute avoidance or resolution.

However, the level of knowledge of the Act amongst subcontracting organisations overall has not improved since study, and may have even declined.

It is clear that contractors and subcontractors are not taking full advantage of the Act. The research compares key performance indicators for the purpose of determining whether or not the Act produces the expected result of increasing security of payment, and whether the results are consistent with the reason for the Act.

The 2018 Amendments to the Security of Payments Act 1999

The changes are primarily directed at promoting timely payment of subcontractors, but also could make the preparation of payment schedules more onerous for principals and head contractors. A contractor must presently include an endorsement on its payment claim stating that it is made under the SOP Act before being able to avail itself of the rights and remedies provided by the SOP Act. Following the Amendment Bill, this type of endorsement will not be necessary. This means that any claim for payment, whether or not in the form prescribed by the contract, could potentially be the subject of an adjudication application under the SOP Act. At a practical level, a SOP Act endorsement on a payment claim served to alert a principal or head contractor that it must serve a payment schedule within 10 business days or be liable for the full amount claimed, and that the payment schedule must set out all reasons for non-payment of any amount.

The Building and Construction Industry Security of Payment Act known as the SOP Act helps ensure that any person who carries out construction work or supplies related goods and services under a construction contract gets paid. The Amendment Act received assent on 28 November and the amendments will take effect upon proclamation. Some of the changes proposed in the Draft Bill were ultimately passed in the Amendment Act without amendment. However, other changes have evolved throughout the public consultation and parliamentary processes. An example of a reform that evolved throughout the public consultation and parliamentary processes is the removal of the concept of "reference dates". Whereas the Draft Bill sought to amend the definition of "reference date" so that contractors would be entitled to progress payments at least once per month or more frequently if agreed for work done within that month, the Amendment Act has removed the concept of "reference dates" altogether. The Amendment Act now provides that payment claims " may be served on and from the last day of the named month in which the construction work was first carried out " unless the construction contract makes provision for an earlier date, in which case payment claims may be served on and from that date. Whilst the practical effect of the Draft Bill and the Amendment Act may ultimately be the same, the Amendment Act goes one step further to remove the confusion in relation to the definition of "reference date" that was identified in the National Review.
